TREC Amendment to Contract (Form 39-11): What It Actually Changes

Ten checkboxes — the entire menu of things you're allowed to amend on a signed TREC contract.

TREC's Amendment form is renumbering: the version effective 07/01/2026 is TREC No. 39-11, replacing TREC No. 39-10 (the printed form text carries a revision date of 05-04-2026). It's used to modify a contract after it has already been signed by the parties — the form frames it as: "Seller and Buyer amend the contract as follows," with ten checkboxes covering the full range of changes TREC's form allows.

The ten things you can check

  1. Sales price. Broken into cash portion payable at closing, the sum of financing described in the contract, and the total sales price (the sum of both).
  2. Additional repairs and treatments the seller will complete at seller's expense, beyond what the contract already requires. The form notes Paragraph 7 of the contract governs completion, documentation, and transfer of warranties for repairs and treatments.
  3. Closing date — the date in Paragraph 9 of the contract.
  4. The amount in Paragraph 12A(1)(b) of the contract.
  5. The amounts in Paragraph 12B — how much seller and/or buyer will pay, each as either a flat dollar amount or a percentage of the sales price.
  6. Cost of lender-required repairs and treatment, itemized on an attached list, split by dollar amount between seller and buyer.
  7. An additional option fee the buyer pays the seller to extend the unrestricted right to terminate the contract, through a specific date and time (the form specifies 5:00 p.m.) — with a checkbox for whether this additional fee will or will not be credited to the sales price.
  8. Buyer waives the unrestricted right to terminate the contract for which the option fee was originally paid.
  9. The date for buyer to give written notice that Buyer cannot obtain Buyer Approval, as set forth in the Third Party Financing Addendum, changed to a new date.
  10. Other modifications — with the form's own caution printed directly beside the checkbox: "Real estate brokers and sales agents are prohibited from practicing law."
Consult an attorney before signing. The form repeats this warning in bold directly above the signature block: "TREC rules prohibit real estate brokers and sales agents from giving legal advice. READ THIS FORM CAREFULLY."

Execution line

The form closes with: "EXECUTED the ____ day of ____________, 20____. (BROKER: FILL IN THE DATE OF FINAL ACCEPTANCE.)" — a date distinct from the original contract's Effective Date, and one the form explicitly assigns to the broker to complete.
